User Agreement — Gold Merge Mania

Overview

This User Agreement governs your access to and use of Gold Merge Mania mobile application and all related features, gameplay, services, and server functions (collectively referred to as the “Service”). By downloading, installing, accessing, or using our Service, you confirm that you have read, understood, and agree to abide by all terms in this User Agreement and our published Privacy Policy. If you do not accept these terms, you must immediately stop using the Service and uninstall the application from your device.

Key Definitions

For the purposes of this User Agreement, the definitions set out in our Privacy Policy shall apply equally herein:

• Application / App: Gold Merge Mania mobile game application.
• Company / We / Us / Our: The operator and owner of Gold Merge Mania.
• User / You: Any individual who accesses, downloads, installs, or uses the App and Service.
• Account: Your unique virtual identity generated for accessing restricted features, game progress saving, and service interaction.
• Device: Any smartphone, tablet, or electronic device capable of running the App.
• Personal Data: Any identifiable personal information collected, stored, and processed in accordance with our Privacy Policy and applicable laws including CCPA, CPRA, GDPR, and VCDPA.
• Service Provider: Third-party entities that provide advertising, analytics, cloud, payment, or technical support on our behalf.
• Usage Data: Automatically collected data generated from your use of the App and server infrastructure.

Eligibility to Use the Service

1. You must be at least 13 years of age to use this Service.
2. If you are under 18 years old, you must obtain explicit consent from your parent or legal guardian to use the App, and such guardian shall accept and be bound by this Agreement on your behalf.
3. You warrant that you are not restricted, banned, or prohibited from using the Service under local laws or prior account enforcement actions.
4. You agree to use the Service only for lawful purposes and comply with all applicable regional laws, platform rules, and third-party service terms.
5. We reserve the right to suspend or terminate your access if you fail to meet the above eligibility requirements.

Permitted & Prohibited Use

Permitted Use

You are granted a limited, non-exclusive, non-transferable, revocable license to use Gold Merge Mania solely for personal, non-commercial entertainment purposes.
You may:

• Access all official gameplay features and in-game content;
• Save, sync, and manage your game progress across supported devices;
• Receive in-app advertisements as part of free service operation;
• Submit support inquiries and exercise your privacy rights as stated in our Privacy Policy;
• Use legitimate in-app functions and withdrawal services where available.

Prohibited Use

You expressly agree NOT to:

• Modify, reverse-engineer, decompile, hack, tamper with, or alter the App code, server files, game logic, or in-game assets;
• Use bots, scripts, automation tools, cheats, plug-ins, or third-party modified clients to gain unfair advantages;
• Interfere with server stability, overload network resources, or disrupt other users’ gameplay experience;
• Collect, scrape, or distribute user data, device information, or server content without our written permission;
• Use the App for fraud, illegal transactions, harassment, spam, commercial promotion, or any unlawful activity;
• Sell, rent, share, transfer, or trade your game account, in-game assets, or progress to any third party;
• Bypass advertisement display, service restrictions, or content limitations set by the App;
• Misrepresent your identity, impersonate our staff, or falsely claim official authorization.
• We may immediately restrict, suspend, or permanently ban your account for any violation of the above rules.

Account Management & Responsibility

• Your game account is linked to your device identifiers and protected by internal server records. You are solely responsible for maintaining device security and preventing unauthorized access.
• We are not liable for any loss of game progress, asset loss, or data leakage caused by your device negligence, account sharing, or rule violations.
• We retain the right to reset, suspend, or terminate your account at any time for abnormal behavior, rule violations, cheating, or server security requirements.
• If you stop using the Service continuously for 90 days, we may delete your personal data and inactive account records in accordance with our Privacy Policy.

Intellectual Property Rights

All intellectual property rights within Gold Merge Mania — including game graphics, artwork, sound effects, code, design, trademarks, server logic, text content, and in-game assets — are exclusively owned or licensed by the Company.

• You may not copy, reproduce, distribute, modify, resell, or create derivative works of any App content without our prior written approval.
• No intellectual property ownership is transferred to you through your use of the App.
• Any unauthorized commercial use or infringement will result in account termination and potential legal action.

Data Privacy & Third-Party Services

Your use of the Service is subject strictly to our Privacy Policy. By agreeing to this User Agreement, you fully consent to our data collection, usage, storage, sharing, and protection practices outlined in the Privacy Policy.

Data Collection

We automatically collect device information, usage data, advertising IDs, app interaction data, and limited personal information including PayPal account name and email only for withdrawal processing and service delivery. All data collection follows the data minimization principle and TLS 1.2+ encryption protection.

Third-Party Advertising & Partners

The App relies on third-party advertising networks to maintain free gameplay. We integrate partners including AppLovin, Chartboost, Google, InMobi, IronSource, Kwai Network, Fyber, Mintegral, Moloco, Bytedance, Vungle, Unity Ads, Yandex, BidMachine, Verve, and Bigo.

• We only share non-sensitive device data, ad identifiers, session metrics, and basic demographic information.
• We never share your personal contact details, PayPal credentials, precise location, or private gameplay data with third advertisers.
• You may opt out of targeted advertising via your Android or iOS device settings as described in our Privacy Policy.

Anonymized usage data is collected for performance monitoring, game optimization, and error detection. Temporary local data storage may apply during endpoint maintenance.

In-App Purchases & Withdrawal Terms

• All in-app purchases processed via official platform channels are final, non-refundable, and non-exchangeable unless required by applicable law.
• In-game withdrawal services, if available, are processed via PayPal. You authorize us to use your PayPal account email and name solely for transferring eligible funds.
• We reserve the right to adjust withdrawal rules, limits, and processing times at our discretion.
• We are not responsible for payment failures, third-party platform delays, or errors caused by incorrect user-provided PayPal information.

Privacy Rights (CCPA, CPRA, GDPR, VCDPA)

We respect all user privacy rights under applicable data protection laws:

• California residents hold Right to Know, Right to Delete, Right to Opt-Out of data sale, and Right to Non-Discrimination under CCPA/CPRA.
• EEA residents hold access, rectification, erasure, restriction, and objection rights under GDPR.
• Virginia residents hold access, correction, deletion, data portability, and opt-out rights under VCDPA.

Children's Privacy

Our Service is not intended for users under the age of 13. If you are a parent or guardian and become aware that your child has provided us personal data without consent, please contact us immediately to request data removal.

Disclaimer of Warranties

The App and all related services are provided on an “as is” and “as available” basis without any express or implied warranties.
We do not warrant uninterrupted operation, bug-free performance, server stability, compatibility with all devices, or error-free service. You use the App entirely at your own risk.

Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or financial loss including game progress loss, data loss, profit loss, or gameplay interruption arising from your use of the Service. Our total liability for any claim shall not exceed the amount you have paid within the preceding 12 months.

Termination of Agreement

• Your Termination: You may stop using the Service and uninstall the App at any time to terminate this Agreement.
• Our Termination: We may suspend or permanently terminate your account and access without prior notice if you violate this Agreement, engage in cheating, harm server security, or violate legal requirements. Upon termination, all licenses granted to you shall immediately cease, and you must stop all use of the App.

Modifications to This Agreement

We may update this User Agreement periodically. Changes take effect immediately upon posting inside the App with an updated “Last Updated” date. Your continued use of the Service after updates constitutes acceptance of the revised terms.

General Clauses

• If any clause of this Agreement is deemed invalid or unenforceable, remaining clauses shall remain fully valid.
• This User Agreement together with our Privacy Policy constitutes the entire binding agreement between you and the Company.
• You may not assign this Agreement to any third party; we may assign our rights without user consent.
